GENERAL TERMS AND CONDITIONS OF SALE – REALBE SPORTS

Article 1 – The Seller

These general terms and conditions of sale are entered into by and between the non-profit organization REALBE SPORTS (hereinafter referred to as “Sunday Cycling Club” or “SCC”), whose registered office is located at Avenue Louise 490, Box 6, 1050 Brussels, Belgium, registered under BCE number 0538.678.117, and reachable at info@beautifulsports.be, and any individual wishing to register and participate in events organized by REALBE SPORTS (hereinafter referred to as “the Participant”).

Article 2 – Purpose

2.1. These general terms and conditions of sale aim to define the contractual relationship between REALBE SPORTS and the Participant, specifying the respective rights and obligations of the parties, as well as the terms applicable to any registration made via the website https://www.sundaycyclingclub.be.

2.2. These General Terms and Conditions and any specific conditions or notices appearing on the Site constitute the entire agreement governing the contractual relationship between REALBE SPORTS and the Participant.

2.3. Purchasing a service via the REALBE SPORTS website implies the Participant’s unconditional and express acceptance of these general terms and conditions of sale. The electronic ordering process implies acceptance of the terms and conditions of sale.

2.4. These general terms and conditions are accessible at any time on the Site and shall prevail, where applicable, over any other version and over any general terms and conditions of purchase or otherwise provided by the Participant.

Article 3 – Offered Services or Products

3.1. REALBE SPORTS’ primary purpose is the organization of sports events of all types.

3.2. The services offered are those listed in the catalog published on REALBE SPORTS’ various websites (BBFL & Sunday Cycling Club). Each offered service has its dedicated site containing all terms and practical details. These services are offered subject to availability or defined limits. Each service is accompanied by a comprehensive description established by REALBE SPORTS on its site (registrations, content, duration, date, etc.).

3.3. REALBE SPORTS’ service offers are made without commitment and only bind REALBE SPORTS once accepted unreservedly by the Participant and following written confirmation of the Buyer’s order by the Seller.

Article 4 – Order and Payment

4.1. Any Participant wishing to purchase a Service must:

  • Complete the order form with all required information;
  • Make payment under the specified terms;
  • Accept these general terms and conditions.
    4.2. Order confirmation will be communicated by REALBE SPORTS by email and shall constitute the signature and acceptance thereof by REALBE SPORTS.
    4.3. Payment is made online on the site (Bancontact or others). No other payment methods are accepted.
    REALBE SPORTS is in no way responsible for any issues the Participant may encounter during transactions with payment companies used.

Article 5 – Pricing

5.1. The prices of REALBE SPORTS services are indicated in Euros, all taxes included (TTC), and are payable in Euros.

5.2. The prices do not include any additional costs or fees unless specifically mentioned in the catalog.

5.3. REALBE SPORTS reserves the right to modify its prices at any time but no later than at the time of contract conclusion.

Article 6 – Special Terms for REALBE SPORTS Members

6.1. Certain services are only accessible to Participants who are members of REALBE SPORTS.

6.2. REALBE SPORTS Membership:

6.2.1. To become a REALBE SPORTS member, the Participant must meet the following conditions:

  • Pay the membership fee;
  • Review and accept the REALBE SPORTS internal regulations available at: https://www.REALBE SPORTS.be/regulations.

Article 7 – Special Terms for Non-Members of REALBE SPORTS

7.1. Certain services are accessible to Participants without requiring membership with REALBE SPORTS. Registration is done online only, under the conditions described on www.sundaycyclingclub.be.

7.3. Non-members of REALBE SPORTS may not register for or participate in events reserved for REALBE SPORTS members.

Article 8 – Contract Termination

8.1. Upon the end of the season or event organized by REALBE SPORTS, all related services terminate, except for access to REALBE SPORTS’ virtual platform as specified in these terms and conditions. The Participant understands that the contractual relationship between the two parties ends at the close of the season or event.

8.2. In the event of any breach of these general terms, REALBE SPORTS may terminate the contract with the Participant immediately and without further formality, without refund, and with the option to revoke access to its events, Platform, and content, and to seek damages due to harm suffered from the breach.

8.3. Without prejudice to Article 8.2., REALBE SPORTS may terminate the contract with the Participant without justification if the Participant is known for unsportsmanlike conduct, aggressiveness, or any problematic behavior.

Article 9 – Image Rights

9.1. For events organized by REALBE SPORTS, the Participant grants REALBE SPORTS the right to film or photograph them, alone or with others, for internal, promotional, or informational purposes. REALBE SPORTS may publish and use these images on its Site and any other medium, including promotional brochures or social media pages.

9.2. This authorization is granted unless the Participant objects to the distribution of a specific image. Use and dissemination of REALBE SPORTS’ images will not infringe on the Participant’s reputation or privacy.

Article 10 – Intellectual Property

10.1. All intellectual elements provided to the Participant (software, documentation, etc.) and all elements of the website www.sundaycyclingclub.be (textual content, articles, illustrations, images, photos, tutorials, videos, diagrams, layout, etc.) are protected by copyright law and remain the exclusive property of the Seller.

10.2. Unless expressly agreed otherwise, the agreed price does not include any transfer of intellectual property rights.

Article 11 – Responsibilities

11.1. General Provisions:

REALBE SPORTS is generally only held to a best-efforts obligation unless specified otherwise. Additionally, REALBE SPORTS is only liable for intentional or gross negligence.

11.1.2. In case of non-performance, REALBE SPORTS is not liable if the failure results from an unforeseeable and insurmountable event from a third party, or from force majeure as defined in Article 11 of these terms.

11.1.3. Under no circumstances shall the directors, managers, employees, agents, or representatives of REALBE SPORTS be held liable for any direct or indirect claims or damages arising from the use of the Site, paid or free services, public information, or interpretation of this contract.

Article 12 – Force Majeure

12.1. In cases of force majeure, the parties' obligations are suspended until the force majeure event ceases or adjusted to what is feasible given the circumstances.

12.2. Force majeure includes any unforeseeable, unavoidable event beyond the parties' control that constitutes an insurmountable obstacle to fulfilling obligations, including but not limited to health-related restrictions, power or natural gas shortages, network failures, and property or operational decisions making venue use significantly more costly or impossible.

12.3. In cases of force majeure, the Participant is not entitled to any refund or compensation from REALBE SPORTS.

Article 13 – Changes in Venue, Date, or Event Cancellation

13.1. Without prejudice to Article 11, if circumstances beyond REALBE SPORTS’ reasonable control prevent the event organization or a part thereof as scheduled, REALBE SPORTS may cancel, relocate, change the date, or shorten the event duration. The Participant acknowledges that no refund, compensation, or expenses are due in these circumstances.

Article 16 – Governing Law and Jurisdiction

16.1. Belgian law is exclusively applicable.

16.2. Any disputes arising from this agreement that cannot be settled amicably are subject to the exclusive jurisdiction of the courts in the judicial district of Brussels.
